Fees as of November 2026
Immigration Filing Fees 2026 (USCIS & Immigration Court)
This page lists the government fee for each common immigration form, grouped by type of case. For example, a family-based Form I-130 costs $675 on paper or $625 online, and a Board of Immigration Appeals appeal (Form EOIR-26) costs $1,060. These are fees you pay to the government. They are separate from attorney fees. Our guide to what an immigration lawyer costs in Connecticut covers legal fees.
Key dates
- October 1, 2026: EOIR fiscal year 2027 amounts took effect (EOIR fee page).
- October 16, 2026: USCIS FY2027 inflation amounts apply to filings postmarked on or after this date (Form G-1055, edition 10/26/26).
- October 28, 2025: USCIS stopped accepting paper checks for mailed forms (USCIS announcement). Pay by card or bank transfer (ACH) with Form G-1450 or G-1650. Form G-1651 is for people who qualify for an exemption.
- February 23, 2026: EOIR began taking payments only through the EOIR Payment Portal (EOIR fee page).
Fee waivers
Many USCIS forms allow a fee waiver request on Form I-912, but not all of them do, and the asylum fees cannot be waived. For a BIA appeal or motion, ask for a waiver with Form EOIR-26A. Our guide to the BIA appeal fee waiver and payment process explains the steps.
Proposed rule, not final: on June 23, 2026, DHS proposed new N-400 and N-336 fees that would also end the reduced N-400 fee and fee waivers for those forms (Federal Register). Until a final rule is published, the current amounts below apply.

Frequently asked questions
Does USCIS still accept paper checks?
No. USCIS stopped accepting paper checks on October 28, 2025. You pay by credit or debit card or by bank transfer (ACH) using Form G-1450 or G-1650. Some people are exempt and can use Form G-1651. Check the form instructions for your filing.
How do I pay immigration court fees?
Since February 23, 2026, EOIR accepts fees only through the EOIR Payment Portal. It no longer accepts checks or money orders. Include proof of payment with your filing, or the court or the BIA may reject it.
Can I get a fee waiver?
For many USCIS forms you can ask for a waiver on Form I-912 if you meet the rules, but not every form allows one. The asylum fees cannot be waived. For a BIA appeal or motion, the waiver request is Form EOIR-26A. Some forms, such as I-864, I-918 and VAWA petitions, have no fee at all.
Do these fees include a lawyer?
No. These are government fees. They are paid to USCIS, EOIR, the State Department or a federal court. Attorney fees are separate and are set by each law office.
Will the N-400 fee go up?
DHS published a proposed rule on June 23, 2026 that would raise the N-400 and N-336 fees, end the reduced N-400 fee and end fee waivers for both forms. It is not final. Until a final rule is published, the amounts on the USCIS fee schedule apply.
Which date controls the fee amount?
For USCIS, the FY2027 inflation amounts apply to filings postmarked on or after October 16, 2026. If you send a filing with the wrong fee, USCIS can reject it. Always check the current fee schedule (Form G-1055) the day you file.
Not sure which fee applies to your case?
Fees depend on the form, the filing method and your situation. We can review your case with you.
